PMBS Code of Conduct

The PMBS Code of Conduct establishes the ethical and professional standards expected of every Chartered Professional Mediator (ChPM). These standards protect the public, support party self‑determination, and ensure that mediation is practiced with integrity, neutrality, and professionalism.

All applicants must agree to uphold the Code of Conduct, and all Chartered Mediators must adhere to it as a condition of maintaining their credential.

Neutrality and Impartiality

Mediators must remain neutral and impartial throughout the mediation process.
This includes:

  • Avoiding favoritism or bias
  • Managing power imbalances
  • Disclosing any potential conflicts of interest
  • Withdrawing from a case when neutrality cannot be maintained

Neutrality is foundational to party trust and the integrity of the process.

Confidentiality

Mediators must protect the confidentiality of all mediation communications, except where disclosure is required by law or agreed upon by the parties.
This includes:

  • Safeguarding written and verbal information
  • Maintaining secure records
  • Respecting the privacy of all participants

Confidentiality supports open dialogue and honest problem‑solving.

Competence and Professionalism

Mediators must practice within the boundaries of their training, experience, and expertise.
They are expected to:

  • Prepare adequately for each mediation
  • Maintain current knowledge through continuing education
  • Seek supervision or consultation when appropriate
  • Decline or withdraw from cases beyond their competence

Competence ensures that parties receive high‑quality, ethical service.

Party Self‑Determination

Mediators must respect the right of parties to make their own decisions.
This includes:

  • Supporting voluntary participation
  • Avoiding coercion or pressure
  • Ensuring parties understand their options
  • Encouraging informed decision‑making

The mediator’s role is to facilitate — not direct — outcomes.

Integrity and Ethical Conduct

Mediators must conduct themselves with honesty, fairness, and professionalism.
They must:

  • Avoid misrepresentation of qualifications
  • Refrain from promising specific outcomes
  • Maintain appropriate boundaries
  • Uphold all legal and ethical obligations

Integrity is essential to public trust in the mediation profession.

Quality of the Mediation Process

Mediators must manage the process in a way that promotes safety, respect, and productive dialogue.
This includes:

  • Creating a safe environment for all participants
  • Managing disruptive behavior
  • Ensuring balanced participation
  • Addressing ethical concerns promptly

The mediator is responsible for the quality and fairness of the process.

Accountability

Mediators must be accountable for their conduct and responsive to concerns raised by parties, colleagues, or PMBS.
This includes:

  • Cooperating with PMBS inquiries
  • Complying with disciplinary procedures
  • Reporting significant ethical or legal issues
  • Maintaining required professional liability insurance

Accountability ensures the ongoing credibility of the ChPM designation.
